Whether You are accessing or have accessed any of Club Mahindra’s sites, services, offerings, Content, products, or applications, by way of the internet web sites located at the urls www.ClubMahindra.com, or by way of a mobile device, smart-phone, tablet, reader, application or app, software, tangible content medium (including a dvd or flash drive), Facebook, Twitter, a video service (such as YouTube or Vimeo) (none of which Club Mahindra is affiliated with), or any other device or method now known or developed in the future (individually and collectively, “the,” “any,” or “a” “Club Mahindra Platform”) the terms and conditions set forth below to indicate they are integrated into this, the, or these Terms Of Service / End User License Agreement (collectively, "Terms") govern Your viewing, entering, or using any Club Mahindra Platform, and any of the offerings, Content, products, and services of Club Mahindra, including Your subscription to and use of Club Mahindra website. The Terms do not govern your use of your holidays, which has its own terms, notwithstanding any use herein of the phrase “any” or “every Club Mahindra Platform.” These Terms are a legal contract between Club Mahindra and You, an individual user of at least 18 years of age, or if You are using or subscribing to or making a purchase from Club Mahindra on behalf of any entity -- including a company, organization, or trust, no matter the legal form of the entity, then You represent and warrant that You are an authorized representative of that entity with the authority to bind such entity to the Terms, and agree to be bound by the Terms on behalf of such entity ("You," “user,” or, collectively, "users," whether in uppercase, lowercase, or a combination).

1. ELIGIBILITY

The conditions apply to users who contribute to the Community Section of Club Mahindra.com. If You are under the age of 18 Your parent or legal guardian must enter into this agreement on Your behalf. If You are under the age of 18 You affirm that by Your continued or future use of any Club Mahindra Platform or any of the offerings, Content, products, and services of Club Mahindra, Your parent or legal guardian has first agreed to the Terms, including as amended, on Your behalf.

If You do not agree to or with any and each and every of the terms in these Terms, exit or close the Club Mahindra Platform immediately and do not access or otherwise use any Club Mahindra Platform, offerings, Content, products, services, or any information contained on or through any Club Mahindra Platform. Your use of any Club Mahindra Platform, offerings, Content, products, services, or any information contained on or through any Club Mahindra Platform shall be deemed to be Your agreement to abide and be bound by each of the Terms set forth herein. You acknowledge that You have read and understood, and agree to be bound by, the Terms (and conditions).

You are bound by Club Mahindra’s terms and conditions and its privacy policy if you visit the Community Section of ClubMahindra.com.

2. LICENSE GRANT TO DOWNLOAD AND USE CONTENT

Subject to Your compliance with the terms and conditions set out in the Terms, Club Mahindra hereby grants to You a personal, limited, non-exclusive, non-transferable, freely revocable license to view viewable Content, and in some instances download and print Content through the Club Mahindra Platform subject to the license under which such User Content and Materials are made available and distributed inside the Community Section of ClubMahindra.com.

If You are not a Club Mahindra Member or subscriber, You may only be able to view certain Content on Club Mahindra, but may not be able to download or print the same unless You purchase a Membership. If You are a Club Mahindra Member, so long as You are paid in full, and all the information You have provided is and remains true, accurate, and complete, then subject to Your compliance with the terms and conditions set out in these Terms, Club Mahindra hereby grants to You a personal, limited, non-exclusive, non-transferable, freely revocable license to view, and in many instances download, save, print, and use, Content available to Premium Members (depending upon Your subscription or membership) solely through a Club MahindraPlatform subject to the license under which such Content is distributed or made available. The license granted to You is for Your exclusive personal use.

Any distribution, resale, or re-licensing of any aspect of any Content to third parties for any reason is strictly prohibited, unless used through after login through membership section and Community Section of ClubMahindra.com.

Content, and all aspects of it, on, through, or from Club Mahindra and a Club Mahindra Platform, may not be resold, redistributed, relicensed, reproduced, or made available on any site, web-page, blog, or other method, except where Content is available in an embeddable Club Mahindra viewer and there is no prohibition associated with embedding such document on Your web-page. You may do so utilizing the embeddable Club Mahindra provided within the Community Section of ClubMahindra.com. Notwithstanding the foregoing, Club Mahindra may limit the Content and number of documents that You may view, download, or print within any given time period.

3. LICENSE GRANT TO UPLOAD

YOU WILL NOT UPLOAD WORKS THAT YOU DO NOT HAVE THE RIGHTS TO. YOU WILL NOT INFRINGE UPON THE COPYRIGHT OR ANY OTHER RIGHT OF ANY OTHER PERSON OR ENTITY.

Subject to Your compliance with the terms and conditions set out in these Terms, Club Mahindra hereby grants to You a personal, limited, non-exclusive, non-transferable, freely revocable license to use the Club Mahindra Platform for the uploading, submitting, posting, distributing, or otherwise making available of authorized digital content, including electronic documents, information, messages, comments, or other content or material ("User Content").

User Content uploaded by You is at Your own risk. Notwithstanding any obligations hereunder of Club Mahindra to protect User Content with these Terms or security measures, Club Mahindra cannot and does not guarantee that there will be no unauthorized copying, distribution, or deletion of User Content nor will Club Mahindra be liable for any copying or usage of the User Content not authorized by Club Mahindra or You.

Limitations by Applicable Law

Club Mahindra controls and operates each Club Mahindra Platform from its headquarters in Chennai and abides by Government of India rules, regulations and such acts and laws. A Club Mahindra Platform, Service, or Content may not be appropriate or available for use in other locations. Although Club Mahindra does not direct its activities to users outside of India, if You use any Club Mahindra Platform outside India, You are responsible for following applicable local laws.

You agree to comply with all laws and restrictions and regulations as listed in IT Amendment Act 2008. The transfer of certain technical data and commodities may require a license from an agency of the Indian government and/or written assurances by You that You will not export such software, technical data, or commodities to certain foreign countries without prior approval of such agency. Your rights under the Terms are contingent on Your compliance with this and all other provisions.

USER CONTENT LICENSE GRANT; REPRESENTATIONS AND WARRANTIES

Club Mahindra is not responsible for the content of any websites which are linked to Club Mahindra. You need Club Mahindra’s permission for any copying or redistribution of its contents.You are responsible for keeping your account details secure.

Club Mahindra is not liable for any loss caused to you due to any authorized use of your Club Mahindra account, but you are liable to Club Mahindra for any such damage to Club Mahindra.

• You will not use any software such as 'spiders' to harvest information from Club Mahindra.
• You cannot copy or distribute any material from Club Mahindra for commercial purpose, without its express permission.
• While copying/downloading any material, copyright notices should be left intact.
• You may be allowed to submit content to Club Mahindra (User Submissions), but its confidentiality is not ensured.
• Such content must be your own or you should have copyright owner’s written permission.
• You retain the copyright for your content, but by submitting it to Club Mahindra you are giving Club Mahindra the right to use the material in any form that it may desire. This right will terminate only when you remove the content from Club Mahindra website.
• You will not submit falsehoods or misrepresentations that could damage Club Mahindra or any third party.
• You will also not submit any material which is obscene, defamatory or otherwise objectionable, or unlawful.
• You will also not post advertisements or solicitations of business, or impersonate another person.
• Club Mahindra will remove all content considered inappropriate or that violates somebody’s intellectual copyrights. Anybody who repeats such activity may also be denied access to Club Mahindra.
• You don’t have any claims against Club Mahindra for User Submissions that are inaccurate, offensive, indecent, or objectionable.
• Your use of Club Mahindra is solely at your risk, and Club Mahindra has no liability for any deficiency in service or damage due to the content, including that from any virus you may get from Club Mahindra.
• Club Mahindra does not claim that its content is appropriate in other countries also.
• You will defend Club Mahindra against any suit connected with your access to Club Mahindra, even after you have discontinued its use.
• You visit Club Mahindra only if you or over 18 years or have parental/guardian consent and are able to understand these conditions.
• You should not use Club Mahindra if you are under 13 years of age.
• You can’t transfer your membership to somebody else.
• The site is subject to only Mumbai courts jurisdiction.
